Ancak AKP h\u00fck\u00fcmeti, b\u0131rakal\u0131m ta\u015feronu yasaklamay\u0131, hem kamuda hem de \u00f6zel sekt\u00f6rde ta\u015feronun \u00f6n\u00fcn\u00fc a\u00e7ma \u0131srar\u0131ndan vazge\u00e7miyor.<br \/>\nYap\u0131lmas\u0131 planlanan d\u00fczenlemelerle ilgili sendikalara, emek \u00f6rg\u00fctlerine b\u0131rakal\u0131m fikir sormay\u0131 adeta gizlenen, kimi sendikalar\u0131n ise gayr\u0131 resmi olarak ula\u015ft\u0131klar\u0131 taslak metinler yanda\u015f medya taraf\u0131ndan ise \u201cta\u015ferona m\u00fcjde\u201d ba\u015fl\u0131klar\u0131 ile sunulmu\u015f, kamuoyunda beklenti olu\u015fturulmaya, h\u00fck\u00fcmet taraf\u0131ndan ta\u015feron \u00e7al\u0131\u015fanlar\u0131n korunaca\u011f\u0131 alg\u0131s\u0131 yarat\u0131lmaya \u00e7al\u0131\u015f\u0131lm\u0131\u015ft\u0131r.<br \/>\n\u00c7al\u0131\u015fma Bakanl\u0131\u011f\u0131 taraf\u0131ndan haz\u0131rlanan \u201c\u0130\u015f Kanunu ile Baz\u0131 Kanun ve Kanun H\u00fckm\u00fcnde Kararnamelerde De\u011fi\u015fiklik Yap\u0131lmas\u0131na Dair Kanun Tasar\u0131s\u0131\u201d 30 May\u0131s 2014 tarihinde Meclise g\u00f6nderildi. Bu kez \u201cMaden i\u015f\u00e7ilerine yeni haklar geliyor\u201d denilerek tart\u0131\u015fmaya a\u00e7\u0131lan tasar\u0131, bu hafta mecliste g\u00f6r\u00fc\u015f\u00fclmeye ba\u015flanacak. 61 Maddeden olu\u015fan Torba Yasa tasar\u0131s\u0131nda ta\u015ferona m\u00fcjde yok, \u201cdaha \u00e7ok ta\u015feron\u201d var.<br \/>\nKanun tasar\u0131s\u0131ndaki maddeler ne getiriyor, ne getirmiyor?<br \/>\n1)- Kanun tasar\u0131s\u0131, kamuoyunda bir s\u00fcredir olu\u015fturulan beklentinin aksine ta\u015feron \u00e7al\u0131\u015fanlara kadro getirmiyor. Ta\u015feronu s\u0131n\u0131rland\u0131racak ya da engelleyecek herhangi bir d\u00fczenleme de \u00f6nermiyor. Tersine ta\u015feronun yayg\u0131nla\u015fmas\u0131n\u0131 sa\u011flayacak d\u00fczenlemeler var. Yani : TA\u015eERONA DEVAM.<br \/>\n2)- Tasar\u0131 ile, ta\u015feronlara kadro verilmesini bir yana b\u0131rakal\u0131m, ta\u015feron i\u015f\u00e7ilerin bug\u00fcn kadroya ge\u00e7mesini sa\u011flayabilecek tek d\u00fczenleme de ortadan kald\u0131r\u0131lmaktad\u0131r.<br \/>\nKanun tasar\u0131s\u0131 ile 4857 say\u0131l\u0131 \u0130\u015f Kanunun 2. Maddesinde yer alan \u201cAs\u0131l i\u015fverenin i\u015f\u00e7ilerinin alt i\u015fveren taraf\u0131ndan i\u015fe al\u0131narak \u00e7al\u0131\u015ft\u0131r\u0131lmaya devam ettirilmesi suretiyle haklar\u0131 k\u0131s\u0131tlanamaz veya daha \u00f6nce o i\u015fyerinde \u00e7al\u0131\u015ft\u0131r\u0131lan kimse ile alt i\u015fveren ili\u015fkisi kurulamaz. Aksi halde ve genel olarak as\u0131l i\u015fveren alt i\u015fveren ili\u015fkisinin muvazaal\u0131 i\u015fleme dayand\u0131\u011f\u0131 kabul edilerek alt i\u015fverenin i\u015f\u00e7ileri ba\u015flang\u0131\u00e7tan itibaren as\u0131l i\u015fverenin i\u015f\u00e7isi say\u0131larak i\u015flem g\u00f6r\u00fcrler. \u0130\u015fletmenin ve i\u015fin gere\u011fi ile teknolojik nedenlerle uzmanl\u0131k gerektiren i\u015fler d\u0131\u015f\u0131nda as\u0131l i\u015f b\u00f6l\u00fcnerek alt i\u015fverenlere verilemez.\u201d F\u0131kras\u0131n\u0131n de\u011fi\u015ftirilmesi, bunun yerine \u201cYedinci f\u0131kra h\u00fck\u00fcmlerine ayk\u0131r\u0131 olarak alt i\u015fverene i\u015f verilmesi veya as\u0131l i\u015fveren i\u015f\u00e7ilerinin haklar\u0131 k\u0131s\u0131tlanmak suretiyle alt i\u015fveren taraf\u0131ndan i\u015fe al\u0131narak \u00e7al\u0131\u015ft\u0131r\u0131ld\u0131\u011f\u0131n\u0131n mahkeme karar\u0131 ile belirlenmesi halinde alt i\u015fverenin i\u015f\u00e7ilerine \u00f6denecek \u00fccret ve di\u011fer sosyal haklar as\u0131l i\u015fverenin emsal i\u015f\u00e7isine \u00f6denene \u00fccret ve sosyal haklardan az olamaz\u201d d\u00fczenlemesi \u00f6nerilmektedir. Ayr\u0131ca \u0130\u015f Kanunun 3. Maddesinin iki, \u00fc\u00e7 ve d\u00f6rd\u00fcnc\u00fc f\u0131kralar\u0131n\u0131n da y\u00fcr\u00fcrl\u00fckten kald\u0131r\u0131lmas\u0131 \u00f6nerilmektedir.<br \/>\nBilindi\u011fi gibi, \u0130\u015f Kanunun 2 ve 3. maddelerine g\u00f6re, ta\u015feron ili\u015fkisinin muvazaal\u0131 (hileli, hukuka ayk\u0131r\u0131) oldu\u011fu tespit edildi\u011finde ta\u015feron ili\u015fkisi sona ermekte, ta\u015feronda \u00e7al\u0131\u015fan i\u015f\u00e7iler de ba\u015flang\u0131\u00e7tan itibaren as\u0131l i\u015fverenin i\u015f\u00e7isi say\u0131lmaktad\u0131r. B\u00f6yle bir durumda ise i\u015f\u00e7iler, hem as\u0131l i\u015fverenin i\u015f\u00e7isi say\u0131lmakta, hem de ge\u00e7mi\u015fe y\u00f6nelik olarak da as\u0131l i\u015fveren i\u015f\u00e7ilerinin hak ve \u00fccretlerini talep edebilmekteydiler. Bu y\u00f6nde D\u0130SK\u2019e ba\u011fl\u0131 DEV SA\u011eLIK \u0130\u015e sendikas\u0131n\u0131n m\u00fccadelesi sonucu elde edilmi\u015f \u00e7ok say\u0131da mahkeme karar\u0131 da bulunmaktad\u0131r. Bu ise, her ne kadar mahkeme kararlar\u0131 \u00e7o\u011funlukla uygulamaya konulmasa da, i\u015f\u00e7iler i\u00e7in kadroya ge\u00e7menin neredeyse tek yolu. Ancak yeni d\u00fczenleme ile ta\u015feron ili\u015fkisinin muvazaal\u0131 oldu\u011funun tespiti halinde, ta\u015feron i\u015f\u00e7ilerin as\u0131l i\u015fverenin i\u015f\u00e7isi say\u0131lmas\u0131 ortadan kald\u0131r\u0131lmaktad\u0131r, sadece ta\u015feron i\u015f\u00e7isine \u00f6denecek \u00fccret ve di\u011fer sosyal haklar\u0131n as\u0131l i\u015fveren i\u015f\u00e7isinden az olmayaca\u011f\u0131 d\u00fczenlemesi kalmaktad\u0131r.<br \/>\nBu durumda ise muvazaal\u0131, yani hileli, yani yasaya ayk\u0131r\u0131 ta\u015feron ili\u015fkisinin \u201cemsal \u00fccret \u00f6denerek\u201d s\u00fcrd\u00fcr\u00fclebilmesi sa\u011flanacakt\u0131r. Yani, tasar\u0131 ile ta\u015feron uygulamas\u0131n\u0131n yaratt\u0131\u011f\u0131 sorunlar yok say\u0131lmakta, muvazaal\u0131 (hileli) yani yasad\u0131\u015f\u0131 ta\u015feron sistemi kal\u0131c\u0131la\u015ft\u0131rmaktad\u0131r. Bu madde, hukuksuz bir i\u015fleme yasall\u0131k kazand\u0131rmak anlam\u0131na gelmektedir.<br \/>\nBu madde ile, b\u0131rakal\u0131m ta\u015ferona kadro vermeyi, halihaz\u0131rda ta\u015feron \u00e7al\u0131\u015fanlar\u0131n kadroya ge\u00e7mesine imkan tan\u0131yan tek d\u00fczenleme de ortadan kald\u0131r\u0131lm\u0131\u015f olacakt\u0131r. Kamudaki ta\u015feron i\u015f\u00e7ilerin, kamu i\u015f\u00e7isi olmalar\u0131n\u0131n \u00f6n\u00fc tamamen kapat\u0131l\u0131yor.<br \/>\nHastaneler, \u00fcniversiteler, madenler ve Karayollar\u0131 ba\u015fta olmak \u00fczere \u00e7ok say\u0131da kamu kurum ve kurulu\u015flar\u0131nda, muvazaay\u0131 kesinle\u015ftiren \u00e7ok say\u0131da yarg\u0131 karar\u0131 var ancak uygulanm\u0131yor. Buna ra\u011fmen, muvazaan\u0131n tespit edilmesi, hem ta\u015feron i\u015f\u00e7iler hem sendikalar bak\u0131m\u0131ndan b\u00fcy\u00fck \u00f6nem ta\u015f\u0131yor. Bu d\u00fczenleme ile ayn\u0131 zamanda, \u00f6zellikle de kamuda muvazaal\u0131 ta\u015feron konusunda verilmi\u015f yarg\u0131 kararlar\u0131 ve bundan sonra da verilebilecek kararlar kar\u015f\u0131s\u0131nda h\u00fck\u00fcmetin \u201c\u00f6nlem almas\u0131\u201d anlam\u0131na gelmektedir. Bunun ise emek\u00e7ilerin de\u011fil, i\u015fverenlerin korunmas\u0131 y\u00f6n\u00fcnde bir \u00f6nlem oldu\u011fu a\u00e7\u0131kt\u0131r.<br \/>\n3) Yukar\u0131da belirtilen madde ile toplum ve \u00e7al\u0131\u015fanlar nezdinde \u201cas\u0131l i\u015fveren i\u015f\u00e7isi ile ayn\u0131 haklar al\u0131nacaksa, ha ta\u015feron ha kadrolu \u00e7al\u0131\u015fm\u0131\u015f, ne fark eder\u201d alg\u0131s\u0131 yarat\u0131lmak istenmektedir. Bu ise olduk\u00e7a tehlikeli bir yakla\u015f\u0131md\u0131r. Bu yakla\u015f\u0131mla ta\u015feron i\u015f\u00e7ilerinin kadroya ge\u00e7me iste\u011fi k\u0131r\u0131lmak istenmekte, kadrolu \u00e7al\u0131\u015fman\u0131n \u00f6n\u00fcne ge\u00e7ilmektedir.<br \/>\n4)- Kamuda ta\u015feron ili\u015fkisinde yasaya ayk\u0131r\u0131l\u0131k tespit edildi\u011finde i\u015f\u00e7iler i\u015fsiz kalacakt\u0131r<br \/>\nTasar\u0131n\u0131n 12. maddesinde getirilen d\u00fczenleme ile, 4734 say\u0131l\u0131 Kanuna ek madde getirilmesi \u00f6nerilmekte ve eklenenler b\u00f6l\u00fcm\u00fcnde \u201c62 nci maddenin birinci f\u0131kras\u0131n\u0131n (e) bendi uyar\u0131nca yap\u0131lan personel \u00e7al\u0131\u015ft\u0131r\u0131lmas\u0131na dayal\u0131 hizmet al\u0131m\u0131 ihaleleri \u00e7er\u00e7evesinde \u00e7al\u0131\u015ft\u0131r\u0131lan personelin, ihale ve s\u00f6zle\u015fme konusu i\u015f d\u0131\u015f\u0131nda ba\u015fka bir i\u015fte \u00e7al\u0131\u015ft\u0131r\u0131lmas\u0131 veya g\u00f6revlendirilmesi veya 4857 say\u0131l\u0131 Kanunun 2 nci maddesinin yedinci f\u0131kras\u0131 h\u00fckm\u00fcne ayk\u0131r\u0131l\u0131k te\u015fkil edecek \u015fekilde i\u015flem ve eylemler yap\u0131lmas\u0131 gibi sebeplerle mahkeme taraf\u0131ndan i\u015f\u00e7i lehine \u00fccret fark\u0131na h\u00fckmedilmesi veya personel \u00e7al\u0131\u015ft\u0131r\u0131lmas\u0131na dayal\u0131 hizmet al\u0131m\u0131 ihalesine \u00e7\u0131k\u0131lmamas\u0131 gerekti\u011fi halde ihaleye \u00e7\u0131k\u0131lmas\u0131 hallerinde s\u00f6zle\u015fme iptal edilerek alt i\u015fveren-as\u0131l i\u015fveren ili\u015fkisi sonland\u0131r\u0131l\u0131r\u201d denmektedir.<br \/>\nBu d\u00fczenlemeye g\u00f6re, kamuda ta\u015feron ili\u015fkilerinde muvazaa tespit edildi\u011finde s\u00f6zle\u015fme iptal edilecek ve ta\u015feron ili\u015fkisi sona erecek. Ta\u015feron ili\u015fkisi sona erdi\u011fi i\u00e7in i\u015f\u00e7iler ta\u015feron i\u015f\u00e7isi olmayacak, yap\u0131lan d\u00fczenleme ile art\u0131k kamunun i\u015f\u00e7isi de olamayacaklar, sadece as\u0131l i\u015fverenin emsal i\u015f\u00e7isinin \u00fccret ve sosyal haklar\u0131 ile kendininki aras\u0131ndaki fark\u0131 talep edebilecekler. Ta\u015feron ili\u015fkisi bitti\u011fi i\u00e7in yeniden ihaleye \u00e7\u0131k\u0131lacak. Ta\u015feron i\u015f\u00e7isinin maliyeti as\u0131l i\u015fveren i\u015f\u00e7isinin maliyetine ula\u015ft\u0131\u011f\u0131ndan, ihaleyi alacak \u015firket \u00fccret ve sosyal haklar\u0131 y\u00fcksek seviyeye ula\u015fm\u0131\u015f olan i\u015f\u00e7ileri \u00e7al\u0131\u015ft\u0131rmaya devam etmek yerine kendi i\u015f\u00e7ilerini getirecek. B\u00f6ylece, muvazaal\u0131 \u00e7al\u0131\u015ft\u0131r\u0131ld\u0131\u011f\u0131 tespit edilen i\u015f\u00e7iler kap\u0131 \u00f6n\u00fcne konacakt\u0131r. Bu durumda ise muvazaan\u0131n tespiti, i\u015f\u00e7ilerin i\u00e7in hak araman\u0131n yan\u0131 s\u0131ra ciddi bir i\u015fsiz kalma riski de do\u011furaca\u011f\u0131ndan i\u015f\u00e7iler muvazaa tespiti istemekten imtina edebilecek. Bu durum ise, ta\u015feronun s\u0131n\u0131rland\u0131r\u0131lmas\u0131n\u0131 bir yana b\u0131rakal\u0131m, hileli ta\u015feronun te\u015fvik edilmesi anlam\u0131na gelmektedir.<br \/>\n5)- Tasar\u0131da, \u0130\u015f Kanunun 3. maddesinin iki, \u00fc\u00e7 ve d\u00f6rd\u00fcnc\u00fc f\u0131kralar\u0131 ortadan kald\u0131r\u0131lmaktad\u0131r.<br \/>\nS\u00f6z konusu ikinci f\u0131kra, \u201cBu Kanunun 2 nci maddesinin alt\u0131nc\u0131 f\u0131kras\u0131na g\u00f6re i\u015f alan alt i\u015fveren; kendi i\u015fyerinin tescili i\u00e7in as\u0131l i\u015fverenden ald\u0131\u011f\u0131 yaz\u0131l\u0131 alt i\u015fverenlik s\u00f6zle\u015fmesi ve gerekli belgelerle birlikte, birinci f\u0131kra h\u00fckm\u00fcne g\u00f6re bildirim yapmakla y\u00fck\u00fcml\u00fcd\u00fcr. B\u00f6lge m\u00fcd\u00fcrl\u00fc\u011f\u00fcnce tescili yap\u0131lan bu i\u015fyerine ait belgeler gerekti\u011finde i\u015f m\u00fcfetti\u015flerince incelenir. \u0130nceleme sonucunda muvazaal\u0131 i\u015flemin tespiti halinde, bu tespite ili\u015fkin gerek\u00e7eli m\u00fcfetti\u015f raporu i\u015fverenlere tebli\u011f edilir. Bu rapora kar\u015f\u0131 tebli\u011f tarihinden itibaren alt\u0131 i\u015fg\u00fcn\u00fc i\u00e7inde i\u015fverenlerce yetkili i\u015f mahkemesine itiraz edilebilir. \u0130tiraz \u00fczerine verilen kararlar kesindir. Rapora alt\u0131 i\u015f g\u00fcn\u00fc i\u00e7inde itiraz edilmemi\u015f veya mahkeme muvazaal\u0131 i\u015flemin tespitini onam\u0131\u015f ise tescil i\u015flemi iptal edilir ve alt i\u015fverenin i\u015f\u00e7ileri ba\u015flang\u0131\u00e7tan itibaren as\u0131l i\u015fverenin i\u015f\u00e7ileri say\u0131l\u0131r.\u201d \u015eeklinde d\u00fczenlenmi\u015f olup, i\u015f m\u00fcfetti\u015fleri taraf\u0131ndan yap\u0131lacak muvazaa incelemesini ve yetkilerini d\u00fczenlemektedir. M\u00fcfetti\u015f raporuna yap\u0131lan itiraz \u00fczerine verilen karar\u0131n kesin oldu\u011fu y\u00f6n\u00fcndeki d\u00fczenleme de, mahkeme karar\u0131n\u0131n temyiz edilemeyece\u011fini ifade etmektedir. Bu f\u0131kran\u0131n y\u00fcr\u00fcrl\u00fckten kald\u0131r\u0131lmas\u0131 ile m\u00fcfetti\u015flerin muvazaa inceleme yetkisi kald\u0131r\u0131lmakta, muvazaan\u0131n tespiti i\u00e7in dava a\u00e7ma zorunlulu\u011fu getirilmektedir. Ayr\u0131ca bu durumda mahkeme kararlar\u0131n\u0131n da temyiz edilmesi m\u00fcmk\u00fcn olacakt\u0131r. Bu ise, muvazaa durumunun tespitini y\u0131llar s\u00fcrecek yarg\u0131lamalara b\u0131rakmak, yani muvazaan\u0131n tespitini zorla\u015ft\u0131rmak demektir.<br \/>\n6) Tasar\u0131n\u0131n 11. maddesinde, 4734say\u0131l\u0131 Kamu \u0130hale Kanununun 62. Maddesi birinci f\u0131kras\u0131nda \u00f6ng\u00f6r\u00fclen de\u011fi\u015fiklik ile kamu kurum ve kurulu\u015flar\u0131nda idarenin y\u00fcr\u00fctmekte oldu\u011fu as\u0131l i\u015flerde ta\u015feron \u00e7al\u0131\u015ft\u0131rman\u0131n kapsam\u0131 geni\u015fletilmektedir. \u00d6zellikle kamuda kadrolu i\u015f\u00e7i eliyle yap\u0131lmas\u0131 \u00f6ng\u00f6r\u00fclen i\u015flerde ta\u015feron \u00e7al\u0131\u015ft\u0131rma kolayla\u015ft\u0131r\u0131lmaktad\u0131r.<br \/>\n7)- \u201cTa\u015feron i\u015f\u00e7ilere yeni haklar\u201d bir aldatmacad\u0131r. Yap\u0131lan, i\u015f\u00e7ilerin ihlal edilen haklar\u0131n\u0131n tekrar d\u00fczenlenmesidir<br \/>\nTasar\u0131n\u0131n 3, 6, 9 ve 15. maddelerinde \u00f6nerilen de\u011fi\u015fikliklerle ta\u015feron \u00e7al\u0131\u015fanlarla ilgili \u00e7e\u015fitli d\u00fczenlemelerin\/ iyile\u015ftirmelerin yap\u0131ld\u0131\u011f\u0131 kamuoyuna yans\u0131t\u0131lmaktad\u0131r. Ancak bu da bir yan\u0131ltmad\u0131r. De\u011fi\u015fiklik \u00f6nerilerinde yer alanlar yeni haklar de\u011fildir, tersine \u00e7o\u011funlukla ta\u015feron i\u015f\u00e7ilerin zaten sahip olduklar\u0131, ancak kullanamad\u0131klar\u0131, hem kamu hem de \u00f6zel sekt\u00f6r taraf\u0131ndan ihlal edilen haklard\u0131r.<br \/>\n3. madde &#8220;\u0130\u015fverenler, alt i\u015fverene i\u015f vermeleri halinde, bunlar\u0131n i\u015f\u00e7ilerinin \u00fccretlerinin \u00f6denip \u00f6denmedi\u011fini i\u015f\u00e7inin ba\u015fvurusu \u00fczerine veya ayl\u0131k olarak resen kontrol etmekle ve varsa \u00f6denmeyen \u00fccretleri hak edi\u015flerinden keserek i\u015f\u00e7ilerin banka hesab\u0131na yat\u0131rmakla y\u00fck\u00fcml\u00fcd\u00fcr.&#8221;<br \/>\n6. madde &#8220;Alt i\u015fveren i\u015f\u00e7ilerinden, alt i\u015fvereni de\u011fi\u015fti\u011fi halde ayn\u0131 i\u015fyerinde \u00e7al\u0131\u015fmaya devam edenlerin y\u0131ll\u0131k \u00fccretli izin s\u00fcresi, ayn\u0131 i\u015fyerinde \u00e7al\u0131\u015ft\u0131klar\u0131 s\u00fcreler dikkate al\u0131narak hesaplan\u0131r. As\u0131l i\u015fveren, alt i\u015fveren taraf\u0131ndan \u00e7al\u0131\u015ft\u0131r\u0131lan i\u015f\u00e7ilerin hak kazand\u0131klar\u0131 y\u0131ll\u0131k \u00fccretli izin s\u00fcrelerinin kullan\u0131l\u0131p kullan\u0131lmad\u0131\u011f\u0131n\u0131 kontrol etmek ve ilgili y\u0131l i\u00e7erisinde kullan\u0131lmas\u0131n\u0131 sa\u011flamakla, alt i\u015fveren ise alt\u0131nc\u0131 f\u0131kraya g\u00f6re tutmak zorunda oldu\u011fu izin kay\u0131t belgesinin bir \u00f6rne\u011fini as\u0131l i\u015fverene vermekle y\u00fck\u00fcml\u00fcd\u00fcr.&#8221;<br \/>\n9. madde ile kamuda \u00e7al\u0131\u015fan ta\u015feron i\u015f\u00e7iler i\u00e7in :<br \/>\n\u201ca) Alt i\u015fverenlerinin de\u011fi\u015fip de\u011fi\u015fmedi\u011fine bak\u0131lmaks\u0131z\u0131n aral\u0131ks\u0131z olarak ayn\u0131 kamu kurum veya kurulu\u015funa ait i\u015fyerlerinde \u00e7al\u0131\u015fm\u0131\u015f olanlar\u0131n bu \u015fekilde \u00e7al\u0131\u015fm\u0131\u015f olduklar\u0131 s\u00fcrelere ili\u015fkin k\u0131dem tazminat\u0131na esas hizmet s\u00fcreleri, ayn\u0131 kamu kurum veya kurulu\u015funa ait i\u015fyerlerinde ge\u00e7en toplam \u00e7al\u0131\u015fma s\u00fcreleri esas al\u0131narak tespit olunur. Bunlardan son alt i\u015fverenleri ile yap\u0131lm\u0131\u015f olan i\u015f s\u00f6zle\u015fmeleri m\u00fclga 1475 say\u0131l\u0131 \u0130\u015f Kanununun 14 \u00fcnc\u00fc maddesine g\u00f6re k\u0131dem tazminat\u0131 \u00f6denmesini gerektirecek \u015fekilde sona ermi\u015f olanlar\u0131n k\u0131dem tazminatlar\u0131 ilgili kamu kurum veya kurulu\u015flar\u0131 taraf\u0131ndan,\u201d<br \/>\n\u201cb) Ayn\u0131 alt i\u015fveren taraf\u0131ndan ve ayn\u0131 i\u015f s\u00f6zle\u015fmesi \u00e7er\u00e7evesinde farkl\u0131 kamu kurum veya kurulu\u015flar\u0131nda \u00e7al\u0131\u015ft\u0131r\u0131lm\u0131\u015f olan i\u015f\u00e7ilerden i\u015f s\u00f6zle\u015fmeleri m\u00fclga 1475 say\u0131l\u0131 \u0130\u015f Kanununun 14 \u00fcnc\u00fc maddesine g\u00f6re k\u0131dem tazminat\u0131 \u00f6denmesini gerektirecek \u015fekilde sona ermi\u015f olanlara, 4734 say\u0131l\u0131 Kanunun 62 nci maddesinin birinci f\u0131kras\u0131n\u0131n (e) bendi kapsam\u0131nda farkl\u0131 kamu kurum ve kurulu\u015funa ait i\u015fyerlerinde ge\u00e7en hizmet s\u00fcrelerinin toplam\u0131 esas al\u0131narak \u00e7al\u0131\u015ft\u0131r\u0131ld\u0131\u011f\u0131 son kamu kurum veya kurulu\u015fu taraf\u0131ndan, i\u015f\u00e7inin banka hesabma yat\u0131r\u0131lmak suretiyle \u00f6denir\u201d<br \/>\n\u201cc)Alt i\u015fveren ile yapm\u0131\u015f oldu\u011fu i\u015f s\u00f6zle\u015fmesi sona ermedi\u011fi gibi, alt i\u015fveren taraf\u0131ndan 4734 say\u0131l\u0131 Kanun kapsam\u0131nda bulunan idarelere ait i\u015fyerleri d\u0131\u015f\u0131nda bir i\u015fyerinde \u00e7al\u0131\u015ft\u0131r\u0131lmaya devam olunan ve bu \u015fekilde \u00e7al\u0131\u015ft\u0131r\u0131ld\u0131\u011f\u0131 s\u0131rada i\u015f s\u00f6zle\u015fmesi k\u0131dem tazminat\u0131 \u00f6denmesini gerektirecek \u015fekilde sona eren i\u015f\u00e7inin k\u0131dem tazminat\u0131 i\u015f\u00e7inin yaz\u0131l\u0131 talebi halinde, k\u0131dem tazminat\u0131n\u0131n s\u00f6z konusu kamu kurum veya kurulu\u015flar\u0131na ait i\u015fyerlerinde ge\u00e7en s\u00fcreye ili\u015fkin k\u0131sm\u0131, kamu kurum veya kurulu\u015funa ait \u00e7al\u0131\u015ft\u0131\u011f\u0131 son i\u015fyerindeki \u00fccretinin y\u0131llan itibar\u0131yla asgari \u00fccret art\u0131\u015f oranlan dikkate al\u0131narak g\u00fcncellenmi\u015f miktar\u0131 \u00fczerinden hesaplanmak suretiyle son kamu kurum veya kurulu\u015fu taraf\u0131ndan i\u015f\u00e7inin banka hesab\u0131na yat\u0131r\u0131lmak suretiyle \u00f6denir. Bu \u015fekilde hesaplanarak \u00f6denen k\u0131dem tazminat\u0131 tutar\u0131n\u0131n, i\u015f s\u00f6zle\u015fmesinin sona erdi\u011fi tarihteki \u00fccreti \u00fczerinden ayn\u0131 s\u00fcreler dikkate al\u0131narak hesaplanacak k\u0131dem tazminat\u0131 tutar\u0131ndan daha d\u00fc\u015f\u00fck olmas\u0131 halinde, i\u015f\u00e7inin aradaki fark\u0131 alt i\u015fverenden talep hakk\u0131 sakl\u0131d\u0131r.\u201d<br \/>\n15. Madde \u201cas\u0131l i\u015fveren-alt i\u015fveren ili\u015fkisinde as\u0131l i\u015fveren, i\u015fyerindeki alt i\u015fverenlerin gerekli i\u015f sa\u011fl\u0131\u011f\u0131 ve g\u00fcvenli\u011fi tedbirlerini al\u0131p almad\u0131\u011f\u0131m g\u00f6zetmek ve denetlemekle y\u00fck\u00fcml\u00fcd\u00fcr.&#8221;<br \/>\nPeki tasar\u0131da yer alan ve yukar\u0131da yer verdi\u011fimiz d\u00fczenlemeler, ger\u00e7ekten yeni midir? Bu say\u0131lanlar, ta\u015feron \u00e7al\u0131\u015fanlar\u0131n daha \u00f6nce sahip olmad\u0131klar\u0131 haklar m\u0131d\u0131r? HAYIR. Bunlar zaten as\u0131l i\u015fverenin halihaz\u0131rda sorumlu\/y\u00fck\u00fcml\u00fc oldu\u011fu konulard\u0131r. Yeni bir hak yoktur. \u00c7\u00fcnk\u00fc, mevcut \u0130\u015f Kanununun 2. Maddesinde halihaz\u0131rda bu sorumluluk tan\u0131mlanm\u0131\u015ft\u0131r: \u201cBir i\u015fverenden, i\u015fyerinde y\u00fcr\u00fctt\u00fc\u011f\u00fc mal veya hizmet \u00fcretimine ili\u015fkin yard\u0131mc\u0131 i\u015flerinde veya as\u0131l i\u015fin bir b\u00f6l\u00fcm\u00fcnde i\u015fletmenin ve i\u015fin gere\u011fi ile teknolojik nedenlerle uzmanl\u0131k gerektiren i\u015flerde i\u015f alan ve bu i\u015f i\u00e7in g\u00f6revlendirdi\u011fi i\u015f\u00e7ilerini sadece bu i\u015fyerinde ald\u0131\u011f\u0131 i\u015fte \u00e7al\u0131\u015ft\u0131ran di\u011fer i\u015fveren ile i\u015f ald\u0131\u011f\u0131 i\u015fveren aras\u0131nda kurulan ili\u015fkiye as\u0131l i\u015fveren-alt i\u015fveren ili\u015fkisi denir. Bu ili\u015fkide as\u0131l i\u015fveren, alt i\u015fverenin i\u015f\u00e7ilerine kar\u015f\u0131 o i\u015fyeri ile ilgili olarak bu Kanundan, i\u015f s\u00f6zle\u015fmesinden veya alt i\u015fverenin taraf oldu\u011fu toplu i\u015f s\u00f6zle\u015fmesinden do\u011fan y\u00fck\u00fcml\u00fcl\u00fcklerinden alt i\u015fveren ile birlikte sorumludur.\u201d Dolay\u0131s\u0131yla, ortada yeni verilen bir hak yoktur, sorumlulu\u011fun yeniden d\u00fczenlenmesi ve \u015fimdiye kadar yap\u0131lan hak ihlallerinin kabul\u00fc vard\u0131r. Ta\u015feron sistemi devam etti\u011fi s\u00fcrece ise hak ihlallerinin s\u00fcrece\u011fi de bilinmez de\u011fildir.<br \/>\n8- Kamuda ta\u015feron yayg\u0131nla\u015facakt\u0131r<br \/>\n\u00c7al\u0131\u015fma ve Sosyal G\u00fcvenlik Bakan\u0131\u2019n\u0131n 2 May\u0131s 2014 tarihinde yapt\u0131\u011f\u0131 a\u00e7\u0131klamaya g\u00f6re kamuda 661 bin ta\u015feron i\u015f\u00e7isi bulunmaktad\u0131r. \u00d6zellikle kamu hizmetleri a\u00e7\u0131s\u0131ndan en kritik alan olan sa\u011fl\u0131k hizmetleri alan\u0131nda ta\u015feron istihdamda ya\u015fanan art\u0131\u015f \u00e7arp\u0131c\u0131d\u0131r. Sa\u011fl\u0131k hizmetlerinde 2002 y\u0131l\u0131nda 11 bin 685 olan ta\u015feron i\u015f\u00e7i say\u0131s\u0131 11 y\u0131l i\u00e7inde yakla\u015f\u0131k 12 kat aratarak 2013 y\u0131l\u0131nda 131 bin 201\u2019e y\u00fckselmi\u015ftir. Bu say\u0131n\u0131n bug\u00fcn itibari ile 160 bini a\u015ft\u0131\u011f\u0131 tahmin edilmektedir. Ta\u015feronluk sadece sa\u011fl\u0131k hizmetlerinde de\u011fil hemen hemen t\u00fcm kamu hizmetlerinde adeta bir salg\u0131n hastal\u0131k gibi yay\u0131lm\u0131\u015f, TBMM\u2019ye kadar uzanm\u0131\u015ft\u0131r. 2005 y\u0131l\u0131nda TBMM b\u00fcnyesinde \u00e7al\u0131\u015ft\u0131r\u0131lan ta\u015feron i\u015f\u00e7i say\u0131s\u0131 sadece 88 iken, bu rakam 2008&#8217;de 383, 2013 y\u0131l\u0131nda bin 19 olmu\u015ftur. Bu d\u00fczenleme ile kamuda ta\u015feron \u00e7al\u0131\u015fma daha da yayg\u0131nla\u015facakt\u0131r.<br \/>\n9) \u2013 Maden i\u015f\u00e7ileri<br \/>\nTasar\u0131da maden i\u015f\u00e7ilerinin \u00e7al\u0131\u015fma ko\u015fullar\u0131na y\u00f6nelik kimi olumlu d\u00fczenlemeler vard\u0131r. Bunlar :<br \/>\n2. Madde : Yer alt\u0131 i\u015flerinde \u00e7al\u0131\u015fan i\u015f\u00e7ilerde k\u0131dem \u015fart\u0131 aranmaz<br \/>\n7. Madde: Yer alt\u0131 i\u015flerinde \u00e7al\u0131\u015fan i\u015f\u00e7iler i\u00e7in \u00e7al\u0131\u015fma s\u00fcresi haftada en \u00e7ok otuzalt\u0131 saat olup g\u00fcnl\u00fck \u00e7al\u0131\u015fma s\u00fcresi alt\u0131 saatten fazla olamaz.<br \/>\n4. Madde : Bu Kanunun 42 nci ve 43 \u00fcnc\u00fc maddelerinde say\u0131lan haller d\u0131\u015f\u0131nda yer alt\u0131 i\u015flerinde \u00e7al\u0131\u015fan i\u015f\u00e7ilere fazla \u00e7al\u0131\u015fma yapt\u0131nlamaz.<br \/>\nYer alt\u0131nda \u00e7al\u0131\u015fan i\u015f\u00e7ilere, bu Kanunun 42 nci ve 43 \u00fcnc\u00fc maddelerinde say\u0131lan hallerde haftal\u0131k otuzalt\u0131 saati a\u015fan her bir saat fazla \u00e7al\u0131\u015fma i\u00e7in verilecek \u00fccret, normal \u00e7al\u0131\u015fma \u00fccretinin saat ba\u015f\u0131na d\u00fc\u015fen miktar\u0131n\u0131n y\u00fczde elli artt\u0131nlmas\u0131 suretiyle \u00f6denir.<br \/>\n5. Madde: &#8220;Yer alt\u0131 i\u015flerinde \u00e7al\u0131\u015fan i\u015f\u00e7ilerin y\u0131ll\u0131k \u00fccretli izin s\u00fcreleri d\u00f6rder g\u00fcn artt\u0131nlarak uygulan\u0131r.&#8221;<br \/>\n38. Madde : 31\/5\/2006 tarihli ve 5510 say\u0131l\u0131 Sosyal Sigortalar ve Genel Sa\u011fl\u0131k Sigortas\u0131 Kanununun 28 inci maddesinin alt\u0131nc\u0131 f\u0131kras\u0131nda yer alan &#8220;55&#8221; ibaresi &#8220;50&#8221; ve sekizinci f\u0131kras\u0131nda yer alan &#8220;mal\u00fcl&#8221; ibaresi &#8220;a\u011f\u0131r engelli&#8221; \u015feklinde de\u011fi\u015ftirilmi\u015ftir. (2006 tarihinden sonra sigortal\u0131 olan yer alt\u0131nda \u00e7al\u0131\u015fan maden i\u015f\u00e7ilerinin emeklilik ya\u015f\u0131 55\u2019ten 50\u2019ye d\u00fc\u015f\u00fcr\u00fclmektedir. )<br \/>\nAyr\u0131ca tasar\u0131n\u0131n 20. maddesindeki d\u00fczenleme ile Soma\u2019da maden oca\u011f\u0131nda kazan\u0131n oldu\u011fu tarihte \u00e7al\u0131\u015fan i\u015f\u00e7iler ile kazada ya\u015fam\u0131n\u0131 yitiren i\u015f\u00e7ilerin ailelerine \u00c7al\u0131\u015fma ve Sosyal G\u00fcvenlik Bakanl\u0131\u011f\u0131nca belirlenen s\u00fcrede fondan \u00f6deme yap\u0131laca\u011f\u0131; 53. Maddedeki d\u00fczenleme ile de Soma\u2019da ya\u015fam\u0131n\u0131 yitiren i\u015f\u00e7ilerin SGK\u2019ya olan bor\u00e7lar\u0131 silinecek ve i\u015f\u00e7ilerin hak sahiplerine yasada yer alan ko\u015fullara bak\u0131lmaks\u0131z\u0131n \u00f6l\u00fcm ayl\u0131\u011f\u0131 ba\u011flanaca\u011f\u0131 d\u00fczenlemesi yer almaktad\u0131r.<br \/>\nNe var ki, bu d\u00fczenlemeler yeterli de\u011fildir. Biliyoruz ki k\u0131smi iyile\u015ftirmeler \u00fclkemizde ya\u015fanan sorunlar\u0131 \u00e7\u00f6zmeyecektir. Ger\u00e7ek bir d\u00fczenleme madenlerin kamula\u015ft\u0131r\u0131lmas\u0131, \u00f6zelle\u015ftirmelerin durdurulmas\u0131, ta\u015feronun tamamen yasaklanmas\u0131, herkese kadro verilmesi, i\u015f\u00e7i sa\u011fl\u0131\u011f\u0131 ve g\u00fcvenli\u011finin sa\u011flanaca\u011f\u0131 ko\u015fullar\u0131n\u0131n olu\u015fturulmas\u0131, herkese g\u00fcvenceli ve insanca ya\u015fayaca\u011f\u0131 ko\u015fullar\u0131n olu\u015fturulmas\u0131 ile m\u00fcmk\u00fcn olabilir. Ta\u015feron \u00e7al\u0131\u015ft\u0131rma t\u00fcmden yasaklan\u0131p i\u015f g\u00fcvencesi sa\u011flanmad\u0131k\u00e7a, i\u015f\u00e7i sa\u011fl\u0131\u011f\u0131 ve g\u00fcvenli\u011fi kurallar\u0131 eksiksiz olarak uygulanmad\u0131k\u00e7a \u00e7al\u0131\u015fanlar\u0131n hem i\u015f hem de can g\u00fcvenli\u011fi \u00fczerindeki tehdit ortadan kalkmayacakt\u0131r.<br \/>\nAncak AKP h\u00fck\u00fcmeti yine bir oyun oynamakta, Soma\u2019da ya\u015fanan katliam\u0131n ard\u0131ndan olu\u015fan tabloyu kendisi i\u00e7in f\u0131rsata d\u00f6n\u00fc\u015ft\u00fcrmek istemektedir. Yap\u0131lmak istenen, tasar\u0131y\u0131 \u201cmaden i\u015f\u00e7ilerine yeni haklar geliyor\u201d diyerek allay\u0131p pullamak, Soma\u2019da ya\u015fananlar\u0131n ard\u0131ndan halk\u0131n duyarl\u0131l\u0131\u011f\u0131n\u0131 ve ac\u0131s\u0131n\u0131 kullanarak, ger\u00e7ekle\u015ftirmek istedikleri ta\u015feron d\u00fczenlemelerini bu arada hayata ge\u00e7irmektir. Eminiz ki yar\u0131n Ba\u015fbakan Erdo\u011fan ve di\u011fer h\u00fck\u00fcmet yetkilileri, haz\u0131rlad\u0131klar\u0131 tasar\u0131ya kar\u015f\u0131 \u00e7\u0131kanlar\u0131 \u201cmaden i\u015f\u00e7ilerinin ko\u015fullar\u0131n\u0131n iyile\u015ftirilmesini istemiyorlar\u201d diyerek su\u00e7layacak, halk\u0131n ac\u0131s\u0131n\u0131 ve duyarl\u0131l\u0131\u011f\u0131n\u0131 kendi \u00e7\u0131karlar\u0131 i\u00e7in kullanmakta teredd\u00fct etmeyeceklerdi.<\/p>\n<p style=\"text-align: justify;\">Sonu\u00e7 olarak; kanun tasar\u0131s\u0131 ta\u015feron i\u015f\u00e7ilerin yarg\u0131 yolu ile kadrolu i\u015f\u00e7i olma imkanlar\u0131n\u0131 sona erdirmekte, as\u0131l i\u015fler dahil olmak \u00fczere yard\u0131mc\u0131 i\u015flerde ta\u015feron \u00e7al\u0131\u015ft\u0131rmay\u0131 yayg\u0131nla\u015ft\u0131rmakta, ta\u015feron i\u015f\u00e7ilerin zaten var olan baz\u0131 \u00f6zl\u00fck haklar\u0131n\u0131n uygulanmas\u0131n\u0131 kolayla\u015ft\u0131rmakta olup, ta\u015feron i\u015f\u00e7ilerin en \u00f6nemli talebi olan kadrolu \u00e7al\u0131\u015fmay\u0131 neredeyse imkans\u0131z hale getirmektedir.<br \/>\nMilyonlarca ki\u015fiyi ve gelece\u011fini ilgilendiren bu yasa tasar\u0131s\u0131 sendikalardan, emek ve meslek \u00f6rg\u00fctlerinden, emek\u00e7ilerden ba\u011f\u0131ms\u0131z olarak haz\u0131rlanm\u0131\u015ft\u0131r. Bu tasar\u0131n\u0131n emek\u00e7ilerin talepleri, gelece\u011fi i\u00e7in de\u011fil, sermayenin gelece\u011fi i\u00e7in haz\u0131rland\u0131\u011f\u0131 bellidir.<br \/>\nBiz Sa\u011fl\u0131k ve Sosyal Hizmet Emek\u00e7ileri Sendikas\u0131 olarak bu yasa tasar\u0131s\u0131na kar\u015f\u0131 b\u00fct\u00fcn sa\u011fl\u0131k ve sosyal hizmet emek\u00e7ilerini birlikte m\u00fccadele etmeye \u00e7a\u011f\u0131r\u0131yoruz.<br \/>\nSoma\u2019da ya\u015fanan b\u00fcy\u00fck i\u015f\u00e7i katliam\u0131 sonras\u0131nda ortaya \u00e7\u0131kan ger\u00e7ekler, ta\u015feron \u00e7al\u0131\u015fman\u0131n yasaklanmas\u0131 ile i\u015f\u00e7i sa\u011fl\u0131\u011f\u0131 ve g\u00fcvenli\u011fi tedbirlerinin al\u0131narak b\u00fct\u00fcn emek\u00e7ilere g\u00fcvenceli \u00e7al\u0131\u015fma ko\u015fullar\u0131n\u0131n sa\u011flanmas\u0131 talebini birle\u015ftirmi\u015ftir.
