O tarihte \u00e7\u0131kar\u0131lan kanunla kamuda \u00e7al\u0131\u015fan ta\u015feron i\u015f\u00e7ilerin as\u0131l i\u015f yard\u0131mc\u0131 i\u015f ayr\u0131m\u0131na dayanarak kadroya ge\u00e7irilmeleri bir tak\u0131m esaslara ba\u011flanm\u0131\u015f ve bu konuda yetki Bakanlar Kurulu\u2019na tan\u0131nm\u0131\u015ft\u0131. Ancak bu konuda yetkili olan Bakanlar Kurulu\u2019ndan da bir karar y\u0131llar ge\u00e7mesine kar\u015f\u0131n \u00e7\u0131kmam\u0131\u015f ve as\u0131l i\u015fin ne oldu\u011fu kesinle\u015ftirilmedi\u011finden ta\u015feron \u015firketler arac\u0131l\u0131\u011f\u0131yla \u00e7al\u0131\u015fanlar\u0131n kadrolu olma hakk\u0131 s\u00fcrekli ertelenmi\u015ftir. Bu belirsizlik nedeniyle her se\u00e7im d\u00f6neminde ta\u015feron \u015firketler arac\u0131l\u0131\u011f\u0131yla \u00e7al\u0131\u015ft\u0131r\u0131lan i\u015f\u00e7ilerin haklar\u0131 t\u00fcrl\u00fc vaatlerle istismar edilmi\u015ftir.<\/p>\n<p style=\"text-align: justify;\">22 Mart\u2019ta Ba\u015fbakan Davuto\u011flu ve \u015eubat ay\u0131nda Maliye Bakan\u0131 Naci A\u011fbal taraf\u0131ndan yap\u0131lan a\u00e7\u0131klamalarda kamuda \u00e7al\u0131\u015fan ta\u015feron i\u015f\u00e7ilerin kamuda istihdam\u0131na y\u00f6nelik olmak \u00fczere ge\u00e7i\u015f ko\u015fullar\u0131, s\u00fcre ve uygulamaya ili\u015fkin usul ve esaslar\u0131n belirlenece\u011fi aktar\u0131lm\u0131\u015ft\u0131r. Ta\u015feronlar\u0131n kadroya ge\u00e7i\u015flerinde as\u0131l i\u015f kavram\u0131n\u0131n \u00f6ne \u00e7\u0131kt\u0131\u011f\u0131 a\u00e7\u0131kt\u0131r. Bu noktada her kurum i\u00e7in ayr\u0131 uygulama y\u00fcr\u00fct\u00fclece\u011finin de sinyali verilmi\u015ftir.<\/p>\n<p style=\"text-align: justify;\">\u0130\u015f Kanunu \u00e7er\u00e7evesinde yaln\u0131zca \u2018yard\u0131mc\u0131 i\u015f\u2019lerin ve \u2018teknolojik nedenlerle uzmanl\u0131k gerektiren i\u015flerin\u2019 ta\u015ferona verilmesi m\u00fcmk\u00fcnd\u00fcr. \u0130\u015f Kanunu\u2019na g\u00f6re, as\u0131l i\u015fin ta\u015ferona verilmesi durumunda dava a\u00e7arak i\u015fverenin ta\u015feron \u015firket de\u011fil ilgili kurum oldu\u011fu y\u00f6n\u00fcnde karar verilir. Bu konuda \u00e7ok say\u0131da dava a\u00e7\u0131lm\u0131\u015f ve zaten kazan\u0131lm\u0131\u015ft\u0131r.<\/p>\n<p>A\u00e7\u0131klamayla ilgili olarak iki \u00f6nemli noktan\u0131n alt\u0131n\u0131 \u00e7izmek gerekmektedir:<\/p>\n<p style=\"text-align: justify;\">Dile getirilen ifadelere bak\u0131ld\u0131\u011f\u0131nda AKP H\u00fck\u00fcmeti ta\u015feron \u015firketler arac\u0131l\u0131\u011f\u0131yla i\u015f\u00e7i \u00e7al\u0131\u015ft\u0131rmadan vazge\u00e7memektedir. Yani ta\u015ferondan vazge\u00e7ilmemektedir. 1 Kas\u0131m 2015 tarihinden sonra i\u015fe girenler a\u00e7\u0131s\u0131ndan ta\u015feron \u00e7al\u0131\u015ft\u0131rma aynen devam ettirilecektir. \u0130\u015f\u00e7ilerin g\u00fcvencesizli\u011fe mahkum edildi\u011fi, sosyal haklar\u0131n\u0131n budand\u0131\u011f\u0131, \u00e7al\u0131\u015fma ko\u015fullar\u0131n\u0131n k\u00f6t\u00fcle\u015fti\u011fi bir sistem olan ta\u015feron \u00e7al\u0131\u015ft\u0131rman\u0131n derhal ortadan kald\u0131r\u0131lmas\u0131 gerekmektedir.<\/p>\n<p style=\"text-align: justify;\">Yap\u0131lan a\u00e7\u0131klamada \u00e7ok say\u0131da ki\u015fi taraf\u0131ndan g\u00f6zden ka\u00e7\u0131r\u0131lan bir di\u011fer \u00f6nemli nokta da \u015fudur: kadro kavram\u0131yla asl\u0131nda bilinen anlam\u0131yla g\u00fcvenceli i\u015fin kastedilmemektedir. Davuto\u011flu 22 Mart\u2019ta yapt\u0131\u011f\u0131 a\u00e7\u0131klamada \u201cS\u00f6z konusu \u00e7al\u0131\u015fanlar\u0131m\u0131z, \u201c\u00f6zel s\u00f6zle\u015fmeli\u201d olarak ald\u0131klar\u0131 \u00fccretle beraber \u00e7al\u0131\u015ft\u0131klar\u0131 yerlerde \u00e7al\u0131\u015fmaya devam edecekler\u201d demi\u015ftir. Benzer bi\u00e7imde Maliye Bakan\u0131 A\u011fbal da ta\u015feron firmada \u00e7al\u0131\u015fan i\u015f\u00e7ilerin, kamuda \u201c\u00f6zel s\u00f6zle\u015fmeli personel\u201d stat\u00fcs\u00fcnde istihdam edileceklerini bildirmi\u015ftir. \u201c\u00d6zel s\u00f6zle\u015fmeli personel\u201d, s\u00f6zle\u015fmesi \u00fc\u00e7 y\u0131lda bir yenilenecek olan personeldir ve bu haliyle tam bir i\u015f g\u00fcvencesi sa\u011flamamaktad\u0131r.<\/p>\n<p style=\"text-align: justify;\">Ayn\u0131 zamanda \u201c\u00f6zel s\u00f6zle\u015fmeli personel\u201d kavram\u0131, ta\u015feron i\u015f\u00e7ilerin maa\u015flar\u0131nda bir iyile\u015fmeye de sebep olmayacakt\u0131r. Yap\u0131lan a\u00e7\u0131klamalara g\u00f6re, \u201c\u00f6zel s\u00f6zle\u015fmeli personele\u201d \u015fu anda ald\u0131\u011f\u0131 ayl\u0131k \u00fczerinden maa\u015f verilecektir.<\/p>\n<p style=\"text-align: justify;\">\u201c\u00d6zel s\u00f6zle\u015fmeli\u201d olarak \u00e7al\u0131\u015ft\u0131r\u0131lacak personelin 12 ay boyunca g\u00f6rev yap\u0131yor olmas\u0131 \u015fart\u0131 aranacak. 3, 6 ay gibi ge\u00e7ici hizmetler kapsam\u0131nda \u00e7al\u0131\u015ft\u0131r\u0131lan personel kanun kapsam\u0131na girmeyecek. Bu nedenle \u00e7ok say\u0131da ta\u015feron i\u015f\u00e7i, ta\u015feron i\u015f\u00e7i olarak \u00e7al\u0131\u015fmaya devam etmek zorunda kalacak.<\/p>\n<p>Bunlar\u0131n yan\u0131 s\u0131ra;<\/p>\n<p style=\"text-align: justify;\">-Kapsama dahil personelin 1 Kas\u0131m 2015\u2019ten \u00f6nce i\u015fe girmi\u015f ve halen \u00e7al\u0131\u015fmaya devam ediyor ve devlet memurlu\u011funa atanmak i\u00e7in aranan \u015fartlar\u0131 ta\u015f\u0131yor olmas\u0131 gerekti\u011fi ifade edilmi\u015ftir.<\/p>\n<p style=\"text-align: justify;\">-Kamuda \u201c\u00f6zel s\u00f6zle\u015fmeli personel\u201d olarak \u00e7al\u0131\u015ft\u0131r\u0131lacak ki\u015finin mesle\u011fi ve kamu hizmetini yapabilmesi i\u00e7in gerekli bilgi ve donan\u0131ma sahip olup olmad\u0131\u011f\u0131n\u0131 belirlemeye y\u00f6nelik s\u0131nav yap\u0131laca\u011f\u0131 ve s\u0131nav\u0131n ayr\u0131nt\u0131lar\u0131n\u0131n kanun tasar\u0131s\u0131nda belirlenece\u011fi s\u00f6ylenmi\u015ftir. Yani ta\u015feron i\u015f\u00e7ilerin kamuda \u201c \u00f6zel s\u00f6zle\u015fmeli personel\u201d olarak \u00e7al\u0131\u015fabilmek i\u00e7in s\u0131nav\u0131 ge\u00e7meleri gerekecektir.<\/p>\n<p style=\"text-align: justify;\">-Ta\u015feron i\u015f\u00e7iler s\u0131nav\u0131 ge\u00e7erek ve gerekli \u015fartlar\u0131 ta\u015f\u0131d\u0131klar\u0131n\u0131 g\u00f6stererek \u201c\u00f6zel s\u00f6zle\u015fmeli personel\u201d olarak \u00e7al\u0131\u015fmaya ba\u015flad\u0131klar\u0131 takdirde ge\u00e7mi\u015fe d\u00f6n\u00fck hak talebinde bulunamayacaklard\u0131r.<\/p>\n<p style=\"text-align: justify;\">-\u201c\u00d6zel s\u00f6zle\u015fmeli personel\u201d olarak \u00e7al\u0131\u015ft\u0131r\u0131lacak ki\u015filer mali haklar\u0131 bak\u0131m\u0131ndan 4\/B kapsam\u0131ndaki s\u00f6zle\u015fmeli personel gibi memurlar\u0131n toplu s\u00f6zle\u015fme d\u00fczenine tabi olacaklar. Sadece emeklilik sisteminde 4\/A kapsam\u0131ndaki personel gibi de\u011ferlendirilecekler.<\/p>\n<p style=\"text-align: justify;\">-\u201c\u00d6zel s\u00f6zle\u015fmeli personel\u201d olmak isteyenler i\u00e7in devlet memuru olman\u0131n gerektirdi\u011fi g\u00fcvenlik ara\u015ft\u0131rmalar\u0131 yap\u0131lacak.<\/p>\n<p style=\"text-align: justify;\">-Kamu kurumlar\u0131 \u201c\u00f6zel s\u00f6zle\u015fmeli personel\u201d kapsam\u0131nda ka\u00e7 ki\u015fiyi istihdam etmek istiyorsa Maliye ya da \u0130\u00e7i\u015fleri Bakanl\u0131\u011f\u0131na bildirecek ve ka\u00e7 ki\u015finin bu stat\u00fcde \u00e7al\u0131\u015faca\u011f\u0131na bu kurumlar karar verecek.<\/p>\n<p style=\"text-align: justify;\">-Emekli ayl\u0131\u011f\u0131 almaya hak kazanm\u0131\u015f ya da 65 ya\u015f\u0131n\u0131 doldurmu\u015f ta\u015feron i\u015f\u00e7ilerin d\u00fczenlemeden yararlanamayacaklar\u0131 belirtilmi\u015ftir.<\/p>\n<p style=\"text-align: justify;\">-Kamuda tam zamanl\u0131 hizmet veren ta\u015feron i\u015f\u00e7i, d\u00fczenlemeden yararlanacak, k\u0131smi zamanl\u0131 \u00e7al\u0131\u015fanlar ise bu haktan faydalanamayacak.<\/p>\n<p style=\"text-align: justify;\">\u2013 \u0130\u015f kolumuzda Aile hekimleri ile i\u015f s\u00f6zle\u015fmesi imzalayarak hizmetli olarak \u00e7al\u0131\u015fan ki\u015filer ile kamuda s\u00f6zle\u015fmeli veya kadrolu olmayan i\u015f kanununa g\u00f6re aile hekimi ile i\u015f s\u00f6zle\u015fmesi imzalayan aile sa\u011fl\u0131\u011f\u0131 elemanlar\u0131 kapsamda de\u011fildir.<\/p>\n<p style=\"text-align: justify;\">-Kadroya al\u0131nacak i\u015f\u00e7ilerin se\u00e7im \u00f6ncesinde i\u015fe girmi\u015f olmas\u0131 \u015fart\u0131 aranacakt\u0131r.<\/p>\n<p style=\"text-align: justify;\">\u00d6zel istihdam b\u00fcrolar\u0131n\u0131n yayg\u0131nla\u015ft\u0131r\u0131lmas\u0131 yoluyla esnek ve g\u00fcvencesiz \u00e7al\u0131\u015fma bi\u00e7imlerini norm haline getiren, ba\u015fta kad\u0131n emek\u00e7iler olmak \u00fczere t\u00fcm \u00e7al\u0131\u015fanlar\u0131 g\u00fcvencesiz i\u015flere mahkum eden AKP H\u00fck\u00fcmeti\u2019nin kamudaki mevcut t\u00fcm ta\u015feron i\u015f\u00e7ilere g\u00fcvenceli i\u015f ve geni\u015f sosyal haklar sa\u011flayaca\u011f\u0131 y\u00f6n\u00fcnde beklenti yaratmak, g\u00fcvencesiz \u00e7al\u0131\u015ft\u0131r\u0131lan emek\u00e7ilerin insanca \u00e7al\u0131\u015fma ve ya\u015fam ko\u015fullar\u0131 sa\u011flanmas\u0131 y\u00f6n\u00fcndeki taleplerini istismar etmek anlam\u0131na gelmektedir.<\/p>\n<p style=\"text-align: justify;\">Sa\u011fl\u0131k alan\u0131nda y\u0131llard\u0131r s\u00fcrd\u00fcrd\u00fc\u011f\u00fcm\u00fcz m\u00fccadelede defalarca kez s\u00f6yledi\u011fimiz \u00fczere sa\u011fl\u0131k ve sosyal hizmet alan\u0131nda ta\u015feron ve g\u00fcvencesiz \u00e7al\u0131\u015fma bi\u00e7imi kabul edilemez. Bu hizmetler ya\u015famsal hizmetler olup kar h\u0131rs\u0131yla, g\u00fcvencesiz bi\u00e7imlerde, d\u00fc\u015f\u00fck \u00fccretlere bu hizmetlerin nitelikli verilmesi m\u00fcmk\u00fcn de\u011fildir. Bu nedenle ayr\u0131ms\u0131z bi\u00e7imde g\u00fcvenceli i\u015f ve g\u00fcvenceli gelecek kamu hizmeti sunan t\u00fcm emek\u00e7ilerin hakk\u0131d\u0131r ve bu hak, kadro ad\u0131 alt\u0131nda yeniden s\u00f6zle\u015fmeli\/g\u00fcvencesiz \u00e7al\u0131\u015fma dayat\u0131larak daha fazla g\u00f6rmezden gelinemez.<\/p>\n<p style=\"text-align: justify;\">H\u00fck\u00fcmetin g\u00fcvencesizle\u015ftirme y\u00f6n\u00fcndeki genel politikas\u0131 bellidir ve planla bir kez daha net bi\u00e7imde ortaya \u00e7\u0131kt\u0131\u011f\u0131 gibi, \u00f6rg\u00fctl\u00fc m\u00fccadele olmaks\u0131z\u0131n i\u015f g\u00fcvencesinin s\u00fcreklili\u011fi m\u00fcmk\u00fcn olmayacakt\u0131r.
