Darbe giri\u015fiminin ya\u015fand\u0131\u011f\u0131 g\u00fcnden bu yana konfederasyon olarak bizim ve pek \u00e7ok toplumsal kesimin, darbecilerle m\u00fccadelenin demokrasi \u00e7er\u00e7evesinde, anayasal s\u0131n\u0131rlar i\u00e7erisinde, hukuka , uluslar aras\u0131 s\u00f6zle\u015fmelere ba\u011fl\u0131 kal\u0131narak s\u00fcrd\u00fcr\u00fclmesi gerekti\u011fine dair yapt\u0131\u011f\u0131m\u0131z uyar\u0131lara ra\u011fmen yay\u0131nlanan Ohal kararnamesine bak\u0131ld\u0131\u011f\u0131nda siyasi iktidar\u0131n s\u00fcreci adeta bir darbe hukukuyla ilerletmeye devam etti\u011fi g\u00f6r\u00fclmektedir.<\/p>\n<p style=\"text-align: justify;\">G\u00f6zalt\u0131 s\u00fcresinin otuz g\u00fcne \u00e7\u0131kar\u0131lmas\u0131ndan, g\u00f6revden al\u0131nan kamu g\u00f6revlilerinin bir daha kamuda istihdam edilmeyece\u011fine, kapat\u0131lan kurum-kurulu\u015flar\u0131n mal varl\u0131klar\u0131n\u0131n Vak\u0131flar Genel M\u00fcd\u00fcrl\u00fc\u011f\u00fc ve Hazineye bedelsiz devrinden ma\u011fdur ve tan\u0131k ifadelerinin adli kolluk g\u00f6revlileri taraf\u0131ndan da al\u0131nabilece\u011fine kadar pek \u00e7ok d\u00fczenleme i\u00e7eren s\u00f6z konusu Kanun H\u00fckm\u00fcnde Kararname ile ilgili olarak \u00f6n\u00fcm\u00fczdeki g\u00fcnlerde kapsaml\u0131 bir a\u00e7\u0131klama yapaca\u011f\u0131z.<\/p>\n<p style=\"text-align: justify;\">Di\u011fer taraftan bu noktada sendikalar\u0131n ve konfederasyonlar\u0131n kapat\u0131lmas\u0131n\u0131 d\u00fczenleyen Kanun H\u00fckm\u00fcnde Kararnameye kay\u0131ts\u0131z kal\u0131namaz<\/p>\n<p style=\"text-align: justify;\">Cumhurba\u015fkan\u0131, Ba\u015fbakan ve Bakanlar Kurulu \u00fcyelerinin imzas\u0131n\u0131 ta\u015f\u0131yan 667 say\u0131l\u0131 Kanun H\u00fckm\u00fcnde Kararname ile pek \u00e7ok \u00f6zel e\u011fitim, \u00f6\u011fretim ve sa\u011fl\u0131k kurulu\u015fu, dernek ve vak\u0131f\u0131n yan\u0131 s\u0131ra 19 sendikan\u0131n kapat\u0131lmas\u0131 d\u00fczenlenmi\u015ftir.<\/p>\n<p style=\"text-align: justify;\">S\u00f6z konusu kararnamede, aralar\u0131nda sendika ve konfederasyonlar\u0131n da yer ald\u0131\u011f\u0131, kapat\u0131lan kurumlar\u0131n bunlarla s\u0131n\u0131rl\u0131 kalmayabilece\u011fi, yeni tespit edilecek kurumlar\u0131n ilgili bakanl\u0131klarda bakan taraf\u0131ndan olu\u015fturulacak komisyonun teklifi \u00fczerine bakan onay\u0131 ile kapat\u0131laca\u011f\u0131 da d\u00fczenlenmi\u015ftir. (2. Madde 3. F\u0131kra)<\/p>\n<p style=\"text-align: justify;\">Kararname ile, Ohal d\u00f6neminde bile ask\u0131ya al\u0131namayacak olan ve anayasan\u0131n 15. maddesinde ifadesini bulan temel haklar \u00e7i\u011fnemekle birlikte uluslararas\u0131 s\u00f6zle\u015fmeler, anayasa ve ilgili pek \u00e7ok kanun maddesi ihlal edilerek sendikalar\u0131 kapatma karar\u0131 d\u00fczenlenmi\u015f ve 2. maddenin 3. f\u0131kras\u0131ndaki \u201ckapat\u0131lan kurumlar\u0131n bunlarla s\u0131n\u0131rl\u0131 kalmayabilece\u011fi\u201d ifadesiyle kapat\u0131lan sendikalar\u0131n d\u0131\u015f\u0131nda kalan sendika ve konfederasyonlara da adeta aba alt\u0131ndan sopa g\u00f6sterilmi\u015ftir.<\/p>\n<p style=\"text-align: justify;\">Kararname\u2019nin \u2018Milli g\u00fcvenli\u011fe tehdit olu\u015fturdu\u011fu tespit edilen Fethullah\u00e7\u0131 Ter\u00f6r \u00d6rg\u00fct\u00fcne (FET\u00d6\/PDY) aidiyeti, iltisak\u0131 veya irtibat\u0131 belirlenen kurum ve kurulu\u015flara y\u00f6nelik\u201d oldu\u011fu ifade edilmektedir. Ancak t\u0131pk\u0131 yakla\u015f\u0131k bir haftad\u0131r s\u00fcren a\u00e7\u0131\u011fa almalarda ya\u015fand\u0131\u011f\u0131 gibi, hi\u00e7bir hukuki gerek\u00e7e g\u00f6sterilmeden ilerletilen bu s\u00fcrecin bir cad\u0131 av\u0131na d\u00f6n\u00fc\u015febilece\u011fine dair kayg\u0131lar\u0131m\u0131z artmaktad\u0131r.<\/p>\n<p style=\"text-align: justify;\">Di\u011fer taraftan KESK olarak, hi\u00e7bir ayr\u0131m yapmaks\u0131z\u0131n, sendika ve konfederasyonlar\u0131n kapat\u0131lmas\u0131na kar\u015f\u0131 oldu\u011fumuzun alt\u0131n\u0131 \u00e7iziyoruz. Sendikal haklar Anayasa\u2019n\u0131n g\u00fcvencesi alt\u0131ndad\u0131r. Konfederasyon ve sendikalar\u0131n Kanun H\u00fckm\u00fcnde Kararname (KHK) ile kapat\u0131lmas\u0131 Anayasa\u2019ya a\u00e7\u0131k\u00e7a ayk\u0131r\u0131d\u0131r.<\/p>\n<p style=\"text-align: justify;\">Sendika kurma hakk\u0131n\u0131n yasayla d\u00fczenlenece\u011fi ve yine yasayla s\u0131n\u0131rlanabilece\u011fi Anayasan\u0131n 51. Maddesinde d\u00fczenlenmi\u015ftir.<\/p>\n<p style=\"text-align: justify;\">6356 say\u0131l\u0131 Sendikalar ve Toplu \u0130\u015f S\u00f6zle\u015fmesi Kanunu\u2019nun 31. maddesinde sendika ve konfederasyonlar\u0131n Cumhuriyet Ba\u015fsavc\u0131s\u0131n\u0131n talebi \u00fczerine mahkeme karar\u0131 ile kapat\u0131labilece\u011fini d\u00fczenlenmi\u015ftir.<\/p>\n<p style=\"text-align: justify;\">Yine 4688 say\u0131l\u0131 Kamu G\u00f6revlileri Sendikalar\u0131 Ve Toplu S\u00f6zle\u015fme Kanunu\u2019nun 37. Maddesi\u2019ndesendika ve konfederasyonlar\u0131n Cumhuriyet Ba\u015fsavc\u0131s\u0131n\u0131n istemi \u00fczerine i\u015f davalar\u0131na bakmakla g\u00f6revli mahall\u00ee mahkeme karar\u0131 ile kapat\u0131labilece\u011fini d\u00fczenlenmi\u015ftir.<\/p>\n<p style=\"text-align: justify;\">Ola\u011fan\u00fcst\u00fc halin uyguland\u0131\u011f\u0131 s\u00fcre boyunca valiler, sendikalar\u0131n kapal\u0131 veya a\u00e7\u0131k toplant\u0131lar\u0131n\u0131, yay\u0131nlar\u0131n\u0131, yapacaklar\u0131 a\u00e7\u0131klamalar\u0131 durdurabilecek, erteleyebilecek veya yasaklayabilecek olduk\u00e7a geni\u015f yetkilerle donat\u0131lm\u0131\u015ft\u0131r. Ancak OHAL Kanunu, sendika kapatma yetkisini i\u00e7ermemektedir.Bu bir s\u0131k\u0131y\u00f6netim uygulamasd\u0131r ve ancak s\u0131k\u0131y\u00f6netim ilan edildi\u011fi durumlarda sendika ve konfederasyonlar kapat\u0131labilir. Bu nedenle OHAL Kanunu\u2019na dayan\u0131larak \u00e7\u0131kar\u0131lan Kanun H\u00fckm\u00fcnde Kararnamelerle sendikalar\u0131n kapat\u0131lmas\u0131 ba\u015fta anayasaya sonra kanunlara ayk\u0131r\u0131d\u0131r.<\/p>\n<p style=\"text-align: justify;\">KESK olarak kime kar\u015f\u0131 olursa olsun e\u011fer ortada bir hukuksuzluk s\u00f6z konusu ise bu hukuksuzlu\u011fun herkes i\u00e7in tehdit olu\u015fturdu\u011funun alt\u0131n\u0131 tekrar \u00e7iziyoruz.
