Siyasi iktidar\u0131n \u201c\u00f6zel s\u00f6zle\u015fmeli personel\u201d modelinden vazge\u00e7ti\u011fine ve ta\u015feron i\u015f\u00e7ilerin kamuda \u201ci\u015f\u00e7i\u201d olarak istihdam\u0131 g\u00fcndeme getirilmi\u015ftir.<\/p>\n<p>Hemen ba\u015f\u0131nda s\u00f6yleyelim, bu olumlu bir geli\u015fmedir. Ta\u015feronlara kadro talebi \u00e7ok uzun y\u0131llard\u0131r g\u00fcndemde olan i\u00e7inde sendikam\u0131z\u0131n da oldu\u011fu Emek \u00d6rg\u00fctlerinin yo\u011fun \u0131srarl\u0131 \u00f6nemli m\u00fccadele s\u00fcre\u00e7leriyle g\u00fcndemde kalm\u0131\u015f siyasi iktidara ad\u0131m att\u0131rm\u0131\u015ft\u0131r.<\/p>\n<p>Zaten AKP, 2015 Kas\u0131m se\u00e7imlerinden \u00f6nce as\u0131l i\u015flerde \u00e7al\u0131\u015fan ta\u015feron i\u015f\u00e7ilere kadro vaat etmi\u015ftir. AKP, 2016 y\u0131l\u0131 Mart ay\u0131nda ise as\u0131l i\u015f-yard\u0131mc\u0131 i\u015f ayr\u0131m\u0131 olmaks\u0131z\u0131n t\u00fcm ta\u015feron i\u015f\u00e7ilere kadro verece\u011fini a\u00e7\u0131klam\u0131\u015ft\u0131r.<br \/>\nDaha \u00f6nce verilen s\u00f6z 2 y\u0131ld\u0131r tutulmam\u0131\u015f, kadro bekleyen ta\u015feron i\u015f\u00e7ilere, \u201c\u00f6zel s\u00f6zle\u015fmeli personel\u201d stat\u00fcs\u00fc dayat\u0131lm\u0131\u015ft\u0131r. Ta\u015feron i\u015f\u00e7ilerden b\u00fcy\u00fck tepki g\u00f6ren bu modelden vazge\u00e7ilmesi, bir l\u00fctuf ya da m\u00fcjde de\u011fil, verilen \u201ckadro\u201d s\u00f6z\u00fcn\u00fcn gere\u011fidir.<\/p>\n<p>H\u00fck\u00fcmetin birka\u00e7 g\u00fcnd\u00fcr yapt\u0131\u011f\u0131 a\u00e7\u0131klamalara ra\u011fmen Ta\u015feron i\u015f\u00e7ilerin kamuya al\u0131nmas\u0131 ile ilgili yasa tasla\u011f\u0131 hala kamuoyu, sendikalar ve ta\u015feron i\u015f\u00e7iler ile payla\u015f\u0131lmam\u0131\u015ft\u0131r. Bu durum b\u00fcy\u00fck bir belirsizlik yaratmakta, kayg\u0131lar\u0131 \u00e7o\u011faltmaktad\u0131r.<\/p>\n<p>Bu noktada SES olarak ta\u015feron i\u015f\u00e7ilerin taleplerini g\u00fcndeme getirmeye, s\u00fcrecin takip\u00e7isi olmaya devam edece\u011fiz. Yap\u0131lan a\u00e7\u0131klamalar sonras\u0131nda \u00e7ok \u00f6nemli belirsizlikler s\u00fcrmektedir<\/p>\n<p><strong>1) Yap\u0131lacak d\u00fczenlemenin kimleri kapsayaca\u011f\u0131 belirsizdir. D\u00fczenleme kamudaki t\u00fcm ta\u015feron i\u015f\u00e7ileri kapsamal\u0131d\u0131r! Mevsimlik i\u015f\u00e7iler ile 4-c\u2019li personel de kapsama al\u0131nmal\u0131d\u0131r.<\/strong><\/p>\n<p>\u00c7al\u0131\u015fma ve Sosyal G\u00fcvenlik Bakan\u0131 a\u00e7\u0131klamas\u0131nda bir\u00e7ok kamu kurum ve kurulu\u015funu s\u0131ralam\u0131\u015f ancak K\u0130T\u2019lerde \u00e7al\u0131\u015fan ta\u015feron i\u015f\u00e7iler ile ilgili bir a\u00e7\u0131klama yapmam\u0131\u015ft\u0131r. \u00d6te yandan \u201cpersonel \u00e7al\u0131\u015ft\u0131r\u0131lmas\u0131na dayal\u0131 hizmet al\u0131m\u0131\u201d d\u0131\u015f\u0131ndaki ihalelerle \u00e7al\u0131\u015ft\u0131r\u0131lan \u00e7ok say\u0131da i\u015f\u00e7inin durumu da belirsizdir. Yap\u0131lacak d\u00fczenleme K\u0130T\u2019lerde \u00e7al\u0131\u015fan ta\u015feron i\u015f\u00e7iler ba\u015fta olmak \u00fczere ihale t\u00fcr\u00fcne bak\u0131lmaks\u0131z\u0131n kamudaki t\u00fcm ta\u015feron i\u015f\u00e7ileri kapsamal\u0131, s\u00f6z verildi\u011fi \u00fczere tek bir i\u015f\u00e7i bile d\u0131\u015far\u0131da kalmamal\u0131d\u0131r.<\/p>\n<p><strong>2) Ta\u015feron i\u015f\u00e7ilerin kamuya al\u0131nmas\u0131nda \u00e7e\u015fitli ko\u015fullar uygulanaca\u011f\u0131 a\u00e7\u0131klanm\u0131\u015ft\u0131r. Ta\u015feron i\u015f\u00e7ilerin t\u00fcm\u00fcne kay\u0131ts\u0131z, \u015farts\u0131z kadro verilmelidir!<\/strong><\/p>\n<p>H\u00fck\u00fcmet yetkililerince yap\u0131lan a\u00e7\u0131klamalara g\u00f6re, ta\u015feron i\u015f\u00e7iler kamuya al\u0131n\u0131rken, g\u00fcvenlik soru\u015fturmas\u0131 ve s\u0131navdan ge\u00e7irilecek, ayr\u0131ca i\u015f\u00e7ilerin emeklilik durumlar\u0131na bak\u0131lacakt\u0131r. Kadro i\u00e7in b\u00f6yle ko\u015ful ve s\u0131n\u0131rlamalara gidilmesi kapsam\u0131 daraltacak, \u00e7ok say\u0131da i\u015f\u00e7i d\u0131\u015far\u0131da kalabilecektir. Soru\u015fturma, s\u0131nav ve benzeri ko\u015fullar, kadro bekleyen i\u015f\u00e7iyi, mevcut ta\u015ferondaki i\u015finden de edip, i\u015fsiz b\u0131rakabilecektir. Oysa yap\u0131lmas\u0131 gereken kamudaki t\u00fcm ta\u015feron i\u015f\u00e7ilere, ko\u015fulsuz-\u015farts\u0131z kadro verilmesi t\u00fcm i\u015f\u00e7ilerin hi\u00e7bir ayr\u0131m yap\u0131lmaks\u0131z\u0131n kadroya ge\u00e7irilmesidir.<\/p>\n<p><strong>3)<\/strong> <strong>Yerel y\u00f6netimlerde \u00e7al\u0131\u015fan i\u015f\u00e7ilere farkl\u0131 bir model \u00f6ng\u00f6r\u00fclmektedir. Yerel y\u00f6netimlerdeki ta\u015feron i\u015f\u00e7iler de kadroya ge\u00e7irilmelidir.<\/strong><\/p>\n<p><strong>4)<\/strong> <strong>Ta\u015feron i\u015f\u00e7ilerin hangi hak ve \u00fccretlerle kamuya ge\u00e7irilece\u011fi belirsizdir. Kamuya ge\u00e7i\u015fte \u00fccret ve hak adaleti sa\u011flanmal\u0131; ta\u015feron i\u015f\u00e7ilerin birikmi\u015f ve kazan\u0131lm\u0131\u015f haklar\u0131 korunmal\u0131d\u0131r.<\/strong><\/p>\n<p>Ta\u015feron i\u015f\u00e7ilerin kamuya hangi hak ve \u00fccretlerle ge\u00e7irilece\u011fi a\u00e7\u0131kl\u0131\u011fa kavu\u015fturulmam\u0131\u015ft\u0131r. \u00c7al\u0131\u015fma ve Sosyal G\u00fcvenlik Bakan\u0131, ta\u015feron i\u015f\u00e7ilerin mevcut \u00fccret d\u00fczeyleri ile birlikte kamuya al\u0131naca\u011f\u0131 y\u00f6n\u00fcnde bir a\u00e7\u0131klama yapm\u0131\u015ft\u0131r. Oysa bug\u00fcn ayn\u0131 i\u015fi yapan, ta\u015feron i\u015f\u00e7i ile kadrolu i\u015f\u00e7i aras\u0131nda ciddi \u00fccret ve hak farklar\u0131 mevcuttur. Dolay\u0131s\u0131yla kamuya ge\u00e7i\u015f s\u0131ras\u0131nda \u00fccret ve hak adaleti sa\u011flanmal\u0131d\u0131r. Ge\u00e7i\u015f s\u0131ras\u0131nda ta\u015feron i\u015f\u00e7ilerin \u00fccret ve haklar\u0131, k\u0131dem s\u00fcreleri ve yapt\u0131klar\u0131 i\u015fe g\u00f6re ayn\u0131 durumda olduklar\u0131 kadrolu i\u015f\u00e7ilerin seviyesine \u00e7ekilmelidir. Aksi takdirde e\u015fit i\u015fe e\u015fit \u00fccret ilkesi uygulanmam\u0131\u015f, mevcut adaletsizlik b\u00fcy\u00fck \u00f6l\u00e7\u00fcde devam etmi\u015f olacakt\u0131r.<br \/>\n\u00d6te yandan ta\u015feron i\u015f\u00e7ilerin kamuda \u00e7al\u0131\u015ft\u0131klar\u0131 s\u00fcreye ili\u015fkin birikmi\u015f ve kazan\u0131lm\u0131\u015f haklar\u0131 mevcuttur. Ancak kamuya ge\u00e7i\u015f s\u0131ras\u0131nda bu haklar\u0131n korunup korunmayaca\u011f\u0131 noktas\u0131nda belirsizlik s\u00f6z konusudur. Yap\u0131lmas\u0131 gereken ta\u015feron i\u015f\u00e7ilerin daha \u00f6nce ta\u015feronda \u00e7al\u0131\u015ft\u0131klar\u0131 t\u00fcm s\u00fcrenin k\u0131dem s\u00fcrelerine d\u00e2hil edilerek kadroya al\u0131nmas\u0131d\u0131r. B\u00f6ylece ta\u015feron i\u015f\u00e7iler, k\u0131dem ve ihbar tazminat\u0131, y\u0131ll\u0131k izin \u00fccreti, k\u0131dem \u00fccreti gibi haklar noktas\u0131nda bir kay\u0131p ya\u015famayacakt\u0131r. \u00d6te yandan bir\u00e7ok ta\u015feron i\u015f\u00e7inin a\u00e7t\u0131klar\u0131 davalar neticesinde hak kazand\u0131\u011f\u0131 alacaklar mevcuttur. Bu alacaklardan vazge\u00e7ilmesi \u015fart\u0131 \u00f6ne s\u00fcr\u00fclmemeli, ta\u015feron i\u015f\u00e7ilerin birikmi\u015f ve kazan\u0131lm\u0131\u015f haklar\u0131 korunmal\u0131d\u0131r.<\/p>\n<p><strong>5)<\/strong> <strong>Ta\u015feron i\u015f\u00e7ilerin kamuya al\u0131nmas\u0131 s\u00fcreci s\u00fcr\u00fcncemede b\u0131rak\u0131lmamal\u0131, siyasi rant arac\u0131 haline getirilmemelidir. Ta\u015feron i\u015f\u00e7iler en k\u0131sa s\u00fcrede kadroya al\u0131nmal\u0131d\u0131r.<\/strong><\/p>\n<p>Ta\u015feron i\u015f\u00e7ilerle ilgili yasal d\u00fczenlemenin Meclis ara tatile girmeden \u00f6nce yasala\u015ft\u0131r\u0131laca\u011f\u0131 ve ard\u0131ndan 3 ayl\u0131k bir s\u00fcre i\u00e7inde ge\u00e7i\u015flerin yap\u0131laca\u011f\u0131 a\u00e7\u0131klanm\u0131\u015ft\u0131r. Haz\u0131rlanan taslak en k\u0131sa s\u00fcrede kamuoyu ve sendikalar ile payla\u015f\u0131lmal\u0131d\u0131r. Yasa. ta\u015feron i\u015f\u00e7ilerin ve sendikalar\u0131n taleplerini kar\u015f\u0131layacak bi\u00e7imde Meclis\u2019ten ge\u00e7irilmeli ve t\u00fcm ta\u015feron i\u015f\u00e7iler en k\u0131sa s\u00fcrede kadroya al\u0131nmal\u0131d\u0131r.
